Observing a moment of silence to express one’s grief

Question: In some places we find people observing a minute’s silence to express their grief over an incident or event. Is this correct in the Sharī‛ah?

Answer: There is no proof for this in the Sharī‛ah. It is makrūh tahrīmī to consider it an act of worship. This practice neither benefits the living nor the dead.

The Sharī‛ahs of the past permitted silence as a form of fasting. The Qur’ān makes reference to Hadrat Maryam radiyallāhu ‛anhā as follows:

اني نذرت للرحمن صوما فلن اكلم اليوم انسيا.

I have vowed a fast to the Merciful [Allāh] so I am not going to speak to any human today.

Our Sharī‛ah considers this to be impermissible. ‛Allāmah Shāmī rahimahullāh says that this is a practice of the fire-worshippers:

(قوله وصوم صمت) وهو أن لا يتكلم فيه لأنه تشبه بالمجوس فإنهم يفعلون.

‛Allāmah Ālūsī (1217-1270 A.H.) writes in his commentary to the above verse:

وقال بعضهم: المراد به الصوم عن المفطرات المعلومة وعن الكلام وكانوا لا يتكلمون في صيامهم وكان قربة في دينهم فيصح نذره وقد نهى النبي عنه فهو منسوخ في شرعنا كما ذكره الجصاص في كتاب الأحكام وروي عن أبي بكر رضي الله تعالى عنه أنه دخل على امرأة قد نذرت أن لا تتكلم فقال: إن الإسلام هدم هذا فتكلمي.

This refers to abstaining from the normal things which are abstained from when a person is fasting and also from speaking. People in the past used to abstain from speech in their fast. It was a way of getting closer to Allāh ta‛ālā. Taking a vow for this was also correct. Rasūlullāh sallallāhu ‛alayhi wa sallam prohibited us from this. It is abrogated in our Sharī‛ah as stated by al-Jassās in Kitāb al-Ahkām. It is related that Abū Bakr radiyallāhu ‛anhu went to a woman who had vowed not to speak. He said: “Islam has put an end to this practice, so you must speak.”

Ibn Qudāmah (541-620 A.H.) writes:

وليس من شريعة الإسلام الصمت من الكلام وظاهر الأخبار تحريمة، قال قيس بن مسلم: دخل أبو بكر الصديق رضي الله عنه على امرأة من أحمس يقال لها زينب فرآها لا تتكلم فقال: ما لها لا تتكلم؟ قالوا:حجت مصمتة، فقال لها: تكلمي فإن هذا لا يحل، هذا من أعمال الجاهلية فتكلمت، رواه البخاري. وروى أبو داؤد بإسناده عن علي رضي الله عنه قال حفظت عن رسول الله صلى الله عليه وسلم أنه قال: لا صمات يوم إلى الليل. وروي عن النبي صلى الله عليه وسلم أنه نهى عن صوم الصمت.

Ad-Durr al-Mukhtār states:

ويكره تحريما (صمت) إن اعتقده قربة وإلا لا...
وقال الشامي: وإنما كره لأنه ليس في شريعتنا لقوله عليه الصلاة والسلام: لا يتم بعد احتلام، ولا صمات يوم إلى الليل. رواه أبو داؤد. وأسنده أبو حنيفة عن أبي هريرة رضي الله عنه أن النبي صلى الله عليه وسلم نهى عن صوم الوصال وعن صوم الصمت. فتح.
